Dismissed from residency before your remediation plan ended
Short answer
Often the program can act before a plan ends if its policies allow it, but a dismissal before the plan's own determination date, or after a suspension kept you from the plan's required tasks, contradicts the plan the program signed. Compare the dismissal letter against the plan, the policy it cites, and your summative, and raise every gap in writing within your appeal window.
Your plan set the date your progress would be judged. Did the program wait for it?
A remediation plan is a document the program wrote and signed. It sets a length, mentor-report dates, committee-review dates, required tasks, and how its endpoints will be measured. When a program dismisses a resident before the plan's own determination date, the plan is often the strongest evidence in the file.
Send us your plan and your dismissal letter: start a confidential intake. We will look at the dates first.
Line up four documents
Put these side by side:
- The remediation plan. Its length, its review dates, its required tasks, and how endpoints are measured.
- The dismissal letter. The date, the grounds, and the policy it cites.
- The policy page it cites. What that step requires, and what must come before it.
- Your summative and recent evaluations. What they rate satisfactory.
Then ask: did the dismissal come before the plan's own determination date? Do the grounds include anything the plan never covered, or anything the summative rated satisfactory? Did the program skip a step in its own discipline ladder? Each gap is a point for your appeal, regardless of the merits. See how to read a remediation plan.
Check what happened during the plan
- Did a suspension or leave remove you from tasks the plan required?
- Did a scheduled mentor report or committee review pass with no communication?
- Does the program's own written summary of an earlier plan record improvement, or no finding of failure?
- Were approved supports or accommodations tied to the plan actually in place?
Write the dates down. The program's own documents are usually the strongest evidence.
Act inside the appeal window
Some written-appeal windows are as short as five business days from receipt of the dismissal. Get help the same week. If you emailed the program offering to resign before getting advice, withdraw it in writing. See deadlines you cannot miss.
The modest ask is often the strongest
If you were dismissed before the plan was finished, the ask may be simply to finish it, and have the decision revisited on a complete record. Some policies list repeating the training year under a new plan as the alternative to termination. What a realistic outcome can look like covers the other terms residents ask for.
It can work. In a matter we worked on, an institutional appeal committee found that a program had dismissed a resident before letting them finish a required evaluation and remediation, and the dismissal was rescinded. See the case study and what to do after a rescission.

Common questions
- Can my residency dismiss me before my remediation plan ends?
- Some policies allow immediate action for serious events, so read yours. But a plan sets its own length, review dates, and endpoints. A dismissal before the plan's determination date, without a new event the policy covers, is a gap worth raising in writing in your appeal.
- What if I was suspended during my remediation plan and then the plan failed?
- A suspension can remove a resident from the very tasks the plan requires. Ask in writing, at the start of any suspension, that the plan clock pause and that missed tasks be rescheduled. If the plan was declared unsuccessful after that, say so in your appeal, with the dates.
- What can I ask for if my remediation plan was cut short?
- Often the modest ask is the strongest: complete the plan, or repeat the training year under a new plan where the policy lists that as an alternative to termination, and have the decision revisited on a complete record.
