Your residency dismissal was rescinded on appeal. What now?
Short answer
Get the return in writing: who coordinates it, what happens first, and the dates. Ask that the steps you were not allowed to finish, such as an evaluation or remediation, be set out with clear terms and a fair clock. Ask in writing about your pay and status for the gap, and that your file show the dismissal was rescinded. On a J-1, report the change to Intealth. Keep every document, and have counsel read anything new before you sign it.
A rescinded dismissal is a win. It is also a return to a program that recently tried to end your training, so the first weeks back matter.
If your dismissal was just rescinded, start a confidential intake and tell us what the decision letter says comes next.
Get the return in writing
The decision letter may name an office, such as graduate medical education, to coordinate next steps. Ask that office in writing:
- Who is coordinating your return, and who you report to.
- What happens first, and the dates.
- Whether you are back on the schedule, on leave, or in another status until those steps are done.
Keep the decision letter and every reply.
Finish what you were not allowed to finish
Rescissions often turn on steps the program skipped, such as a required evaluation or a remediation plan. Ask for those steps to be set out with clear terms before they begin:
- For an evaluation: who performs it, what it covers, and what the program will receive. See what to ask about a fitness-for-duty evaluation.
- For remediation: the named deficiencies, the criteria for completion, who evaluates, and the review dates. See read a remediation plan like a contract.
Ask how time already spent counts, and confirm the clock in writing.
Ask about pay, status, and the gap
Ask in writing what your pay, benefits, and appointment status were for the period between the dismissal and the rescission, and whether anything will be restored. Ask how that time counts toward training, because it can affect your board eligibility. See the board eligibility clock.
Make sure your file says what happened
Ask that your file reflect that the dismissal was rescinded, and ask what your program will say if asked to verify your training. A dismissal that was rescinded should not read like a dismissal. See get your file and a wrong training verification.
On a J-1, tell your sponsor
J-1 physicians must notify Intealth of changes to their training, including termination and remediation. If the dismissal was reported, the rescission should be too. Report it through MyIntealth and keep a copy. See Intealth (ECFMG) and residency dismissal.
The same protections still apply
Any new action against you is still governed by your institution's due process policy, which the ACGME requires, with the same notice and appeal rights. Keep a dated record of what happens after your return, and have counsel read anything new before you sign it, especially a last chance agreement.
It happens
In a matter we worked on, the institution's appeal committee found that a program had dismissed a resident before letting them finish a required evaluation and remediation. The dismissal was rescinded, and the resident returns to finish both. See the case study.
Every matter turns on its own record, contract, and policies, and a similar appeal can end differently. This is general information, not legal advice.

Common questions
- My residency dismissal was rescinded. What should I do first?
- Get the return plan in writing: who coordinates it, what comes first, and the dates. Then ask in writing about your pay and status for the gap and how your file will show the rescission.
- Does a rescinded dismissal mean my remediation starts over?
- It depends on what the decision says and on your program's policy. Ask for the remediation terms in writing, with the deficiencies, the criteria for completion, who evaluates, and the dates, before the clock starts.
- Can my program take a new adverse action after a dismissal is rescinded?
- A new action is still governed by the same due process policy, with the same notice and appeal rights. Keep calendaring every deadline, and get advice on anything new before you respond.
