Suspended from residency with no letter: what to do the same day
Short answer
Ask in writing, the same day, for written notice of the suspension, the policy it falls under, the reason, and what ends it. Appeal clocks usually run from receipt of a written adverse action, so a suspension never put in writing may still be open to challenge. If you are on a remediation plan, ask that its clock pause while you are kept from the work it requires.
You were told you are suspended. Nothing is in writing. That matters more than you think.
Verbal suspensions are one of the most common patterns in residency discipline. A short meeting, an instruction to leave the schedule, and no letter. No policy named, no reason stated in writing, no return date. The silence that follows can last weeks.
Tell us when the suspension started and what you were told: start a confidential intake.
Why the missing letter matters
- Your appeal clock. Grievance and appeal deadlines usually run from receipt of the written adverse action. A suspension never put in writing may still be open to challenge.
- The discipline ladder. Most institutions have a written policy with defined steps. A verbal removal often fits no step at all. Map what happened against the policy, step by step. Skipped steps matter regardless of the merits.
- How it is recorded. A disciplinary suspension and administrative leave pending investigation read very differently on every verification form.
Same day: one short email
Send it to your program director, copied to the GME office. Keep it factual and short. Ask:
- What your status is, in writing.
- Which policy it falls under, and which step of that policy.
- The reason for it.
- What ends it, and when it will be reviewed.
- Whether it will be recorded as a suspension or as administrative leave.
Do not argue the merits, apologize, or offer to resign. Keep a copy outside your institutional account.
If you are on a remediation plan
A suspension can remove you from the very tasks your plan requires, after which the plan is declared unsuccessful. At the start of any suspension, ask in writing that the plan clock pause and that missed mentor reports, rotations, and review dates be rescheduled. See how to read a remediation plan.
Keep a log
Write down each conversation the day it happens: the date, who was present, what was said, and what you were shown. Download your evaluations, milestones, and procedure logs while you still have access. The free Residency Record is built for this.
If the silence continues
Programs sometimes go quiet for weeks, then act. Ask in writing for your status during any silence, so the gap is on the record. The first 72 hours on administrative leave checklist covers the rest of the first week.
If this is happening to you
Facing a deadline from your program? Tell us when the suspension started, what you were told, and whether anything has been put in writing since. We will review your situation confidentially and point you to the right next step: start a confidential intake.
Resident Help is not a law firm, and submitting an intake does not create an attorney-client relationship. If your situation needs a lawyer, we will tell you and help you find one.
Common questions
- Can my residency program suspend me without written notice?
- It happens. Many institutional policies expect written notice of an adverse action and name the policy tier it falls under. Ask for written notice the same day, and keep a dated record of what you were told and by whom.
- Is administrative leave the same as a suspension?
- Not on paper. Administrative leave pending investigation and a disciplinary suspension read very differently on verification and licensing forms. Ask which one you are on, in writing, and how it will be recorded.
- When does my appeal deadline start if I was never given a letter?
- Appeal clocks usually run from receipt of the written adverse action. If nothing was put in writing, the deadline may not have started, but do not rely on that. Ask for the letter and get advice promptly.
