Dismissed from residency on a J-1 or H-1B visa: the clocks that start
Short answer
A dismissal can trigger notification to your visa sponsor and end your authorized stay on a short timeline, and an internal appeal may not pause it. J-1 physicians are generally sponsored by Intealth (formerly ECFMG); H-1B residents are sponsored by the employing institution. Contact an immigration lawyer the day you receive notice, and ask your program in writing how and when it will report the action to your sponsor.
For a resident on a visa, dismissal starts more than one clock.
A resident on a sponsored visa faces the same internal deadlines as every other resident, plus clocks that the training program does not control. Immigration status can depend on the training position itself. Those clocks can run whatever happens in an internal appeal.

Who your sponsor is
- J-1 physicians in clinical training are generally sponsored by Intealth, formerly ECFMG, which the U.S. Department of State designates as the sponsor for exchange visitor physicians. Changes to your training, including a dismissal, are typically reported to the sponsor. Intealth says a resignation in lieu of termination may end eligibility for future sponsorship, as a termination can. See Intealth (ECFMG) and residency dismissal.
- H-1B residents are sponsored by the employing institution. The status is tied to that employment.
Your sponsor, not your program, administers your immigration status. Find out who your contact is.
Day one
- Contact an immigration lawyer. Not after the appeal. The same day.
- Ask your program in writing how and when it will report the action to your sponsor, and how your status will be handled while any appeal is pending.
- Contact your sponsor's office, with counsel's guidance.
- Calendar every internal deadline at the same time. See deadlines you cannot miss.
Before you agree to anything
The way a separation is timed and characterized can matter to immigration status. Do not resign, accept an election, or sign a separation agreement until immigration counsel has reviewed it alongside your other counsel. See what a realistic outcome can look like.
Keep the rest moving
Everything else in a dismissal still applies: preserve your grievance right, get your file, and plan for pay and insurance. See file this first and get your file before you leave.

If this is happening to you
Contact us the day you receive notice. Tell us what you have received, your visa type, and your deadlines. We will review your situation confidentially and point you to the right next step: start a confidential intake.
Resident Help is not a law firm, and submitting an intake does not create an attorney-client relationship. If your situation needs a lawyer, we will tell you and help you find one.
Common questions
- Who sponsors my visa during residency, and does it matter if I am dismissed?
- It depends on the visa. J-1 physicians are generally sponsored by Intealth, formerly ECFMG, and a termination or a resignation in lieu of termination can end eligibility for future Intealth sponsorship. H-1B residents are sponsored by the employing hospital, so the status is tied to that job. Either way, a dismissal reaches your sponsor, so talk to an immigration lawyer the day you receive notice.
- What happens to an H-1B if I am dismissed from residency?
- An H-1B is tied to the sponsoring employer. When the employment ends, a limited grace period may apply in some cases, but rules are strict and fact-specific. Talk to an immigration lawyer the day you receive notice.
- Does my residency appeal protect my visa status?
- Not necessarily. Immigration timelines can run regardless of an internal appeal. Ask your program in writing how your status will be handled while an appeal is pending, and coordinate with immigration counsel before you agree to anything.
